The 2014 baseball season is officially underway and thousands of South
Floridians will flock to stadiums to see their favorite teams in action.
It doesn’t matter if you’re watching the Marlins play—or
your own favorite Tee-baller, baseball is truly America’s favorite
pastime. Unfortunately, attending a sporting event can be dangerous and
can result in significant injury. If you are injured at a sporting event,
can you file a
personal injury lawsuit? The answer is—maybe.
If you flip over your ticket, there is likely a general release of liability
printed in small print. This acknowledges that the stadium is not responsible
for any injuries you sustain during the normal course of the game. Meaning,
if you get hit in the head with a baseball, you may be out of luck. However,
there are injuries that occur at sporting events that are
not part of the normal course of the game. Some of these include:
- Sexual assault
- Assault and battery by opposing fans
- Improperly secured guard rails or railings
- Faulty or improperly serviced escalators or elevators
- And more
Tyler took his 10-year-old son to see his favorite baseball team play.
After the game, on the way out of the stadium, Tyler encountered some
rather drunk and rowdy fans. They pushed into him, causing him to fall
down the escalator—breaking his hip. Tyler may be able to file a
lawsuit against the man who pushed him, because his injury did not occur
in the normal course of the game and was a direct result of another person’s actions.
Due to the complex nature of these types of injuries, it is important to
speak to an experienced personal injury attorney immediately after you
are injured. You may be able to file a premises liability claim against
the stadium or a personal injury claim against an employee or third party.
Your attorney will be able to review your case and determine if you have
cause to file a claim.
