Florida Senate Approves Legislation to Overhaul Guardianship Laws

On Tuesday - April 28, 2015 - the Florida Senate passed new legislation to substantially change state guardianship laws. The legislation - which was co-sponsored by Kelley/Uustal Attorney and State Representative José Javier Rodríguez - will now head to Governor Rick Scott for approval.

HB 5 was created in response to complaints that elderly individuals who were not capable of managing their own finances were being victimized by court-appointed guardians. As Attorney Rodríguez told the Miami Herald:

“The reforms in this bill help to improve how guardians are appointed, better protect the wishes and rights of an incapacitated person once a guardian assumes power over them and clarify the responsibilities of guardians.”
