Days after boxing’s highly touted Fight of the Century, Kelley/Uustal
filed a lawsuit on behalf of a Palm Beach resident - and other plaintiffs
who paid for the fight - alleging unjust enrichment, breach of contract,
and fraudulent concealment, among other claims. The lawsuit was filed
against Manny Pacquiao, Top Rank Inc., and DirecTV.
The lawsuit - which was filed Tuesday May 5
th in Broward Circuit Court - is centered on the post-fight revelation that
Pacquiao had a shoulder injury leading up to the May 2
nd bout, yet lied on the medical form he signed under oath prior to the match.
The lawsuit is alleging that had Pacquiao disclosed his pre-existing injury,
the Nevada Athletic Commission would not have allowed the fight to take place.
With a fight worth hundreds of millions of dollars, multiple parties involved
in the production of the fight had financial incentive to make it happen
- despite it coming at the price of misled consumers. Plaintiffs in the
lawsuit are seeking class action status for what they believe amounts to fraud.
