From tainted food to malfunctioning automobiles, manufacturers who fail in their responsibility to keep consumers safe can cause devastating accidents. Resulting injuries can include burns, brain injury, paralysis, poisoning, amputation, and death.

In 2009, Lead Attorney Robert W. Kelley and the team at Kelley/Uustal obtained the largest product liability case in the United States that year, as reported by Lawyers USA. This was one of the nation's largest personal injury awards that year.

There Are Three Main Types of Product Defects

In order for a product to be considered “defective” by law, it must fall into one or more of the following categories: defective manufacturing, defective design, or defective labeling.

#1: Defective manufacturing: Products with manufacturing defects are well designed, but have been made unsafe by the way in which they were physically manufactured.

#2: Defective design: Conversely, products with design defects have been manufactured properly, but are inherently flawed because of the way they were designed.

#3: Defective labeling: Even if a product was safely designed and manufactured, it can still be defective if it does not include adequate warning labels or instructions.

Were Your Injuries Caused By an Auto Defect?

Motor vehicle defects can cause serious injury and death. Motor vehicle accidents are the number one cause of death for Americans under the age of 35, responsible for over 40,000 deaths in an average year. Many of these accidents and deaths are caused by defective car components, defectively designed vehicles, or a deadly combination of the two.

  • Airbag defects
  • Gas tank and fuel fires
  • Carbon monoxide issues
  • Unintended acceleration
  • Seatback failures
