After hearing arguments and witnesses from both sides, a jury returned a verdict in favor of Ms. Sandra Dominguez, our client, who had been injured in a car crash.
The insurance company’s initial offer of 3000 dollars would hardly have begun to pay for the tens of thousands of dollars in medical bills that Ms. Dominguez incurred as a result of a rear-end car crash. The adjusters and lawyers for the defense argued that her injuries were pre-existing, a result of another earlier crash. There was no choice but to go to trial to prove her case.
The Kelley/Uustal team established at trial that Sandra’s injuries were not a result of a previous injury and car accident, but instead were caused by the defendant driver’s negligence in this case. The jury reached their unanimous verdict, finding the defendant 100% at fault for the crash, awarding $80,578.99 for medical bills, future expenses and the pain she will continue to experience.
“We made reasonable offers to avoid trial and they were rejected and ultimately the judgment far exceeded those offers. Sometimes the other side wants to fight to the finish, but we’re always ready for that,” said Todd McPharlin, the lead attorney on this case. “We work up each case as if it were going to trial.” he went on to say.
