Jury awards $10 million in suit against EVAC

DAYTONA BEACH -- The mother of a child born two months prematurely during an ambulance ride has received a $10 million jury verdict for medical expenses, pain and other damages, but EVAC Ambulance vows to appeal.

It was Sept. 21, 2003, when the not-for-profit ambulance provider was called to Bert Fish Medical Center in New Smyrna Beach to transport the pregnant mother,

Margarita Stivers Chess, to the Arnold Palmer Hospital for Children in Orlando.

During the 57-mile transport, according to court papers, Chess' child, Addison Chess, was born at 26 weeks and suffered blindness and brain damage.

The Associated Press reported:

LaHood's warning came Wednesday in testimony before a House Appropriations subcommittee on transportation. LaHood says his advice to owners is to "stop driving it. Take it to a Toyota dealer because they believe they have a fix for it."

 Toyota's most recent recall in the United States affects 2.3 million vehicles with the potential for sticking gas pedals. LaHood told reporters earlier in the day that Toyota owners should contact their dealer immediately and "exercise caution until repairs can be made."

Case signals need for consumer awareness about helmet safety

FORT LAUDERDALE, FL - Linda Bauman was a vivacious young woman before a wakeboarding accident at Quiet Waters in August put her into a coma. Today, her law firm, Fort Lauderdale-based Kelley/Uustal, filed a lawsuit in Broward County Circuit Court against Pro-Tec, the company that manufacturers and sells the sports helmet she was wearing.

Linda was learning the water skiing-type sport when she landed head-first into the water. According to her husband, Les, a lieutenant for the Deerfield Beach Fire Department, she fell into a coma just minutes after swimming to shore.

“I watched her collapse to her knees. I ran over to her and asked her if she was okay,” he said. “She said she didn’t feel well and started rubbing her head.”

FORT LAUDERDALE, FL – On April 23, 2005, Derek Chinni had everything- a wife and son and a new baby on the way. Life could not have been better, but he learned quickly that this was not to be.

While driving his family on State Road 80 in La Belle, Hendry County, Chinni suddenly came upon a turtle the size of a car tire as he came out of a curve in a two-lane road. Chinni tried to avoid collision with the turtle, lost control of the vehicle and ended up upside down in the ditch in three to four feet of water.

Upon impact of the water, the Volvo S60’s tempered glass sunroof exploded. The sturdier laminated glass in the side, rear and front windows remained intact. Laminated glass is high-impact resistant glass which consists of two pieces of glass bonded together with a plastic interlayer, typically consisting of polyvinyl butyral ("PVB").
