Attorney Todd Falzone is currently representing Jason Claire, a 33-year-old husband and father who was shot several times while on-duty as a Boston Market restaurant On New Year’s Day in Tamarac, Florida. This unspeakable act of workplace violence has left Claire permanently injured and unable to work.
The shooter was a disgruntled former employee who shot and killed his love interest in her apartment before visiting the restaurant and shooting Claire several times in the back of the head. The shooter later took his own life. Claire did not work at the Tamarac location and was only there on the day he was shot to cover for another manager. It is unclear why the attacker took aim at Claire, but what is clear is that Boston Market knew that he was a potential danger and failed to act.
The person who found Claire and called 911 assumed he was dead, but miraculously, he has survived and is recovering one day at a time. Claire spent 13 days in a coma and suffered a serious brain injury from the shooting. One of the bullets remains lodged in his jaw, limiting his ability to hear, and the second went through his eye. Left with mounting medical bills and an inability to work, he and his wife have filed a lawsuit against Boston Market for failing to protect him when upper management knew that his attacker had threatened him with weapons in the past.
“Just firing the person without taking any kind of protective measures for the people that are left behind… [is] not enough,” said Falzone.
